TERMS AND CONDITIONS OF RECEIVING AND REDEEMING THE VOUCHERS

I. GENERAL PROVISIONS

1. The present terms and conditions (hereinafter referred to as "Terms and Conditions ") were issued by ALTER ART FESTIVAL SP. Z O.O. residing in Warsaw, ul. Kazimierzowska 14, entered in the register of companies by the 13th division of the District Court for the City of Warsaw under KRS number 227624,Tax identification number (NIP) 586-21-41-557 (hereinafter referred to as ‘Promoter’).

2. The following terms, written with a capital letter, used in the Terms and Conditions hereunder shall have the following meaning:

„Festival” – means an artistic event including music concerts and other artistic and entertainment activities, organized by the Promoter in Gdynia, on the break of June and July every calendar year.
„Edition” – means the Festival organized in a given calendar year.
„2022 Edition” – means an Edition, which took place between June 29 and July 2, 2022 in Gdynia, at Gdynia-Kosakowo Airport.
-„2022 Edition Terms And Conditions” – means the terms and conditions in force during the 2022 Edition, available at the following link: https://opener.pl/en/rules
- „Entitling ticket” – means a one-day ticket entitling an Attendee to enter the 2022 Edition on July 1, two-day ticket allowing to enter the 2022 Edition on July 1 one and July 2, and a four-day ticket allowing to enter the 2022 Edition during all of its days, purchased according to 2022 Edition Terms And Conditions
- „Entitled person” – means every person, who bought an Entitling ticket for him/herself or for another person.
- „Force majeure event” – means extraordinary, impossible to predict atmospheric phenomena in the form of a storm, which occured on July 1, 2022 in the area including the Festival, endangering the health and life of the Festival attendees, due to which the Promoter was forced to temporarily stop the Festival that day and to evacuate the attendees outside its site.

3. The Terms and Conditions are intended for every Entitled person, who bought the Entitling tickets, the holders of which, due to a Force majeure event, could not enter the Festival or had to leave it for the time determined by the Promoter, as a result of the administered evacuation.

4. The aim of The Terms and Conditions is to determine terms and conditions of granting a compensation for every Entitled person, due to the necessity, not attributable to the Promoter, of canceling a part of the concert program planned for July 1, 2022, by issuing vouchers, which can be redeemed on the terms described in Terms And Conditions (herein referred to as Vouchers).

II. THE CONDITIONS OF RECEIVING THE VOUCHERS AND THEIR VALUE

1. Every Entitled person, who wants to receive a Voucher should send an application with his/her name and surname, along with the numbers of the Entitled tickets (a string of numbers below the bar code on the ticket) from the e-mail address used to purchase the Entitled ticket. The applications should be sent by e-mail to [email protected] not later than on October 15, 2022.

2. The Organizer will immediately confirm receiving the application by sending an e-mail to the same address the application has been sent from.

3. The value of the Voucher assigned to the Entitled person is dependant on the kind of the Entitled ticket and the price of its purchase, and equals repectively:

i. In the case of a one-day festival ticket for 01.07.2022 purchased for 299 PLN - 225 PLN;

ii. In the case of a one-day festival ticket for 01.07.2022 purchased for 315 PLN - 235 PLN;

iii. In the case of a one-day festival ticket for 01.07.2022 purchased for 349 PLN - 260 PLN;

iv. In the case of a four-day festival ticket purchased for 459 PLN - 55 PLN;

v. In the case of a four-day festival ticket with campsite purchased for 559 PLN - 55 PLN;

vi. In the case of a four-day festival ticket purchased for 539 PLN - 65 PLN;

vii. In the case of a four-day festival ticket with campsite purchased for 639 PLN - 65 PLN;

viii. In the case of a four-day festival ticket purchased for 607 or 619 PLN - 75 PLN;

ix. In the case of a four-day festival ticket with campsite purchased for 719 PLN - 75 PLN;

x. In the case of a four-day festival ticket purchased for 649 PLN - 80 PLN;

xi. In the case of a four-day festival ticket with campsite purchased for 749 PLN - 80 PLN;

xii. In the case of a four-day festival ticket purchased for 686, 690 or 699 PLN - 85 PLN;

xiii. In the case of a four-day festival ticket with campsite purchased for 819 PLN - 85 PLN;

xiv. In the case of a four-day festival ticket purchased for 739 PLN - 90 PLN;

xv. In the case of a four-day festival ticket with campsite purchased for 859 PLN - 90 PLN;

xvi. In the case of a weekend festival ticket purchased for 419 PLN - 105 PLN;

xvii. In the case of a weekend festival ticket with campsite purchased for 489 PLN - 105 PLN;

xviii. In the case of a weekend festival ticket purchased for 439 PLN - 110 PLN;

xix. In the case of a weekend festival ticket with campsite purchased for 509 PLN - 110 PLN;

xx. In the case of a weekend festival ticket purchased for 459 PLN - 115 PLN;

xxi. In the case of a weekend festival ticket with campsite purchased for 529 PLN - 115 PLN;

xxii. In the case of a weekend festival ticket purchased for 499 PLN - 125 PLN;

xxiii. In the case of a weekend festival ticket with campsite purchased for 589 PLN - 125 PLN;

xxiv. In the case of a weekend festival ticket purchased for 529 PLN - 130 PLN;

xxv. In the case of a weekend festival ticket with campsite purchased for 609 PLN - 130 PLN;

In the case of kids festival tickets, the value of the Voucher equals 50% value of the Voucher issued for a corresponding Entitling ticket purchased for the full price.

4. The Vouchers will be sent by the Promoter to the e-mail address, from which the Entitled person sent the application, no later than in four months from receiving the application sent by the Entitled.

5. If a lack of basis to issue a Voucher is claimed, the Promoter will inform the person who sent the application in the same way and time as described in art.4 above.

6. The right to receive a Voucher does not apply to persons, who held a one-day Entitled ticket for July 1, 2022 and exchanged it to a one-day ticket allowing to enter the Festival on July 2, 2022.

III. THE TERMS AND CONDITIONS OF USING THE VOUCHER

1. Every Voucher will be marked with a unique code and can be used only once.

2. The Voucher issued in accordance to the Terms and Conditions gives the Entitled person the right to lower the price, or part of the price for one-day tickets, two-day tickets or four-day tickets for the Festival Edition in 2023, 2024, or 2025 by the value of the Voucher, under the condition of making the purchase at Altersklep (www.altersklep.pl)

3. To purchase tickets at Altersklep a the buyer needs to be properly registrated at the website, in accordance to „AlterSklep: ticket purchase terms & conditions”, available here: https://www.altersklep.pl/sklep.php?en=1&mode=6

4. The Voucher can be redeemed by the Entitled person not later than in the final day of the Edition of the Festival in 2025. Not using the Voucher in the forementioned time is tantamount to the Voucher becoming invalid. The Promoter will not return the money equivalent of the Voucher, which has not been used in the forementioned term.

5. The Voucher is not subject to exchange for money – not in whole, nor partially.

6. In justified instances, especially caused by random unforseen events, the Entitled person may file an application to the Promoter to consent to an assignment of the rights to the Voucher to a third party. Applications in this matter (including name and surname of the Entitled person, the code of the Voucher, the reason for the assignment, the consent to process the personal data included in the application, as well as the name, surname and e-mail address of the person, to whom the Entitled person wants to assign the right to the Voucher), should be sent by e-mail to [email protected] . The Promoter will inform the Entitled person filing the application about the decision on the consent in 60 days from receiving the application.

7. The Voucher cannot be used to pay for a ticket previously purchased with money, without using the Voucher. The Promoter will not return money for a ticket, if the User decides to use the Voucher after having already paid with a different method.

IV. SETTLEMENTS AND COMPLAINTS

1. All complaints in connection to receiving the Voucher, as well as to buying tickets for the upcoming Editions of the Festival using the Voucher will be examined by the Promoter within thirty days from the date of filing the complaint.

2. The complaints can be filed by e-mail to the address: [email protected] or by written correspondence sent to the address: Alter Art Festival sp. z o.o., ul. Kazimierzowska 14, 02-589 Warszawa. To simplify the complaint procedure, we suggest adding a caption „COMPLAINT” in the title of the e-mail, or on the envelope.

3. If possible, the User should provide the Organizer with all the necessary information and documents concerning the complaint, which can be helpful in the process of its examination. The Promoter will inform about the decision on the complaint by mail or e-mail, depending on the way the complaint was filed.

V. THE EXTENSION OF THE VOUCHER

If an Edition of the Festival, for which the User has bought a ticket with the Voucher, is canceled, the Promoter undertakes extending the validity of the Voucher for a year, beginning from the day the Edition of the Festival (for which the User bought the ticket using the Voucher) was supposed to take place.

VI. FINAL PROVISIONS

1. All questions in connection to the Voucher should be sent to the Promoter’s e-mail address [email protected]

2. Issuing the Voucher is not a sales transaction subject to the goods and services tax within the meaning of relevant tax regulations.

3. According to the law in force, the Voucher is not a form of electronic payment, nor an electronic payment card. A Voucher is an electronic form of a gift certificate.

4. The Promoter reserves the right to make changes to the Terms And Conditions, if it is necessary to adapt the Terms And Conditions to the rules of law, which can change, as well as to delete potential mistakes and inaccuracies in the Terms And Conditions. The actions taken before the changes in the Terms And Conditions come into force are processed in accordance to the existing text of the Terms And Conditions.
